7. Dispute Resolution and Arbitration

If the dispute cannot be resolved within thirty (30) days, either party may elect to submit the dispute to non-binding mediation administered by the American Arbitration Association (AAA) or another mutually agreed-upon mediator in California.

  • Binding Arbitration: If mediation is unsuccessful, any unresolved dispute, claim, or controversy shall be settled by final and binding arbitration administered by the AAA in accordance with its Commercial Arbitration Rules.   • Class Action Waiver: You and PTCP agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis.   • Exceptions: Notwithstanding the above, either party may bring an individual action in small claims court if the claims qualify. Furthermore, either party may seek emergency injunctive relief in a state or federal court located in California to protect its intellectual property rights pending the completion of arbitration.
